Terms and Conditions for MOBI Training Site

Please read these Terms carefully before using the Training Site. These Terms explain who we are, how course access works, your cancellation and refund rights, how you may use course materials, and the limits that apply to the educational content provided through the Training Site.


1. Who we are

These Terms and Conditions("Terms") apply to the MOBI training website, online school and related course pages operated by Metabolic, Obesity & Bariatric Healthcare Ltd (T/A MOBI) through the Teachable platform at https://mobi-training.co.uk/ (the "Training Site").

Metabolic, Obesity & Bariatric Healthcare Ltd (T/A MOBI) is a company registered in England and Wales. Our registered office is 65 Knowl Piece, Wilbury Way, Hitchin, SG4 0TY. In these Terms, "MOBI", "we", "us" and "our" mean Metabolic, Obesity & Bariatric Healthcare Ltd (T/A MOBI). "Student", "user", "you" and "your" mean the person purchasing, accessing or using the Training Site or any course content. Where an employer, organisation or commissioner purchases access on behalf of a student, these Terms also apply to that organisation as far as relevant.


2. Relationship with Teachable and other platform providers

The Training Site is hosted and supported by Teachable. Teachable provides the technology platform, account access, course hosting, checkout functionality and related platform services.

Teachable may require users to accept or comply with its own platform terms, privacy policy, payment terms, data processing terms, acceptable use rules and technical requirements. Those platform terms govern Teachable's own platform services and technology infrastructure.

These Terms govern your relationship with MOBI in relation to MOBI's course content, training materials, student support, certificates, course access decisions and any services supplied by MOBI through the Training Site.

If there is a conflict between these Terms and Teachable's platform terms in relation to Teachable's platform services, Teachable's platform terms may take precedence for those platform services. Nothing in Teachable's platform terms reduces MOBI's obligations to you under applicable UK law where MOBI is the course provider.


3. Use of Teachable Platform

Our online training courses are hosted and delivered through the Teachable platform. These Terms govern the relationship between MOBI and students in relation to the purchase, access and use of MOBI’s training courses, course materials, certificates, support and related services. Teachable’s own platform terms, privacy documentation and data processing arrangements govern Teachable’s provision of the technical platform, hosting, account functionality, payment processing support and related platform services.

Where Teachable processes personal data on behalf of MOBI in connection with course access, enrolment, administration or learner records, such processing is governed by Teachable’s applicable Data Processing Agreement. Teachable may also process certain account, technical, platform or payment-related data in accordance with its own policies. If there is any conflict between MOBI’s course terms and Teachable’s platform terms in relation to the operation of the Teachable platform itself, Teachable’s platform terms will apply to that platform functionality. 4. Scope of these Terms

These Terms apply when you browse the Training Site, create an account, purchase a course, access course materials, attend online training, download materials, submit course activities, receive a certificate or otherwise use the Training Site.

Separate terms may apply to MOBI's patient-facing clinical services, medical consultations, prescriptions, research activities, clinical trial activities or other services outside the Training Site. Those services are not governed by these Training Site Terms unless expressly stated.

By creating an account, purchasing a course or accessing training content, you agree to these Terms. If you are using the Training Site on behalf of an organisation, you confirm that you have authority to bind that organisation where applicable.


5. Nature of the training content

The courses, videos, slides, templates, handouts, quizzes, assessments, discussions and other materials on the Training Site are provided for educational and professional training purposes only.

Unless expressly stated in writing, the Training Site does not provide patient-specific medical advice, clinical supervision, prescribing advice, diagnosis, treatment recommendations, emergency healthcare advice, or a substitute for local clinical governance.

No patient-clinician relationship is created through your use of the Training Site. If you are a patient seeking medical advice, you should contact an appropriate healthcare professional or emergency service.

Healthcare professionals remain responsible for exercising their own professional judgment, complying with applicable professional standards, employer policies, local protocols, regulatory requirements and all laws relevant to their role.

Course materials are prepared using information considered appropriate at the time of publication. Healthcare, clinical guidance and regulatory requirements may change. You must check current guidance, local policy and professional requirements before applying learning in practice.


6. Eligibility and professional status

You must be at least 18 years old to purchase or access courses through the Training Site.

Some courses may be restricted to healthcare professionals, regulated professionals, employees of a particular organisation, commissioners, or specified professional groups. Where eligibility criteria apply, you must provide accurate and complete information.

MOBI may request evidence of eligibility, professional registration, employer status, authorisation or course prerequisites. MOBI may refuse, suspend, cancel or withdraw access if eligibility criteria are not met, if information is inaccurate, or if access would be inappropriate for patient safety, professional governance or regulatory reasons.

You are responsible for ensuring that any course is suitable for your role, professional status, employer requirements and learning needs before purchase.


7. Account registration and security

You may need to create a Training Site account to purchase or access a course. You must provide accurate and up-to-date account information.

You are responsible for keeping your login details confidential and secure. You must not share your login details, allow another person to access a course through your account, or use another person's account.

You must notify MOBI promptly if you believe your account has been compromised or used without permission.

MOBI may suspend or restrict account access where reasonably necessary for security, suspected misuse, non-payment, breach of these Terms, platform requirements, legal compliance or protection of MOBI's rights and course materials.


8. Course purchase, contract formation and access

Course descriptions, prices, access periods, start dates, live session dates, certificate requirements and any eligibility requirements will be set out on the relevant course page or checkout page.

Your order is an offer to purchase course access. A contract is formed when payment is accepted and course access is confirmed, or when MOBI otherwise confirms your enrolment in writing.

Course access is personal to the registered student unless MOBI expressly agrees otherwise in writing. You may not transfer, resell or share access.

Course access periods will be stated on the course page, checkout page or purchase confirmation. If no specific access period is stated, access continues while MOBI keeps the relevant course available on the Training Site, subject to these Terms.

MOBI may provide course access immediately after purchase where you request or agree to immediate digital access. The cancellation consequences of immediate access are explained in section 9 below.


9. Fees, payment, VAT and invoices

Course fees are stated on the relevant course page or checkout page at the time of purchase. Fees may be collected through Teachable, Teachable Payments, Stripe, PayPal or another authorised payment provider.

MOBI does not directly store full payment card details. Payment providers may process payment data in accordance with their own terms and privacy notices.

Prices will state whether VAT or other taxes are included or added at checkout, where applicable. You are responsible for paying all fees and taxes shown at checkout.

Course access is not confirmed until payment has been accepted or MOBI has agreed another written arrangement.

If a payment is reversed, disputed, charged back, declined or not received, MOBI may suspend access until the issue is resolved. This does not affect your statutory rights.


10. Consumer cancellation rights, digital content and refunds

This section applies where you purchase as a UK consumer. A consumer is an individual acting for purposes wholly or mainly outside their trade, business, craft or profession. Business users and employer-sponsored purchases may be subject to the refund terms stated at purchase or agreed in writing.

If you buy a course online as a UK consumer, you may have a statutory right to cancel the contract within 14 days from the day after the contract is made, unless an exception applies.

Digital course content may be supplied immediately after purchase if you request or agree to immediate access. If you give express consent to immediate supply of digital content during the 14-day cancellation period and acknowledge that you will lose your cancellation right once the digital content is made available, you may lose your statutory cancellation right when access begins.

At checkout, MOBI may ask you to confirm wording substantially similar to the following: "I agree to receive immediate access to the digital course content and acknowledge that I will lose my 14-day cancellation right once the digital content is made available to me."

If you purchase a live online session, webinar, workshop or other training service and ask MOBI to begin providing that service during the cancellation period, MOBI may charge a proportionate amount for the service supplied before cancellation.

This section does not affect your statutory rights if digital content is faulty, not as described, not fit for purpose, or if a service is not performed with reasonable care and skill.

Any discretionary refund, satisfaction guarantee, transfer, credit or cancellation policy stated on the course page applies in addition to, and does not reduce, your statutory rights.

Refunds, where due, will normally be made to the original payment method unless MOBI or the payment provider agrees otherwise.


11. Live sessions, webinars and scheduled training

Some courses may include live online sessions, webinars, workshops, tutorials or cohort-based training. Dates, times, attendance requirements and any recording availability will be stated on the course page or in course communications.

You are responsible for ensuring that you can attend any scheduled session and that your device, internet connection, microphone, camera and software are suitable.

MOBI may reschedule, replace, shorten or cancel a live session where reasonably necessary due to illness, low attendance, technical issues, platform issues, safety concerns or circumstances outside MOBI's reasonable control. Where a paid live session is materially cancelled and no reasonable alternative is provided, MOBI will offer an appropriate refund, transfer or credit.

MOBI may record live sessions for training, quality, compliance, replay or course-access purposes. Where recording takes place, students will be informed where reasonably practicable. You must not record, screenshot, download, distribute or publish live sessions without MOBI's prior written consent.


12. Certificates, CPD and completion records

Where a course includes a certificate, the certificate confirms completion of the relevant MOBI training course or the elements specified by MOBI.

A certificate does not by itself confirm clinical competence, professional registration, employment suitability, prescribing authority, regulatory approval, formal accreditation or employer sign-off unless MOBI expressly states this in writing.

If a course is CPD-accredited, externally accredited, employer-approved or linked to a professional requirement, the relevant details and limitations will be stated on the course page or certificate.

MOBI may withhold, correct or revoke a certificate where it reasonably believes that the student has not completed required activities, breached these Terms, provided inaccurate eligibility information, misused the Training Site, or engaged in academic or professional misconduct.

MOBI may keep completion and certificate records for training evidence, audit, support, professional governance and legal purposes, as explained in the Privacy Policy below.


13. Student obligations and acceptable use

You must use the Training Site lawfully, respectfully and only for legitimate training purposes.

You must not: (a) share login details or course access; (b) copy, record, scrape, download or distribute course content except as expressly permitted; (c) attempt to bypass technical restrictions or security measures; (d) upload malware or harmful code; (e) harass, abuse or discriminate against other users or MOBI staff; (f) impersonate another person; (g) provide false information; (h) infringe intellectual property, confidentiality, privacy or data protection rights; (i) use the Training Site to provide competing services or training materials; or (j) use the Training Site for unlawful, unsafe, misleading or harmful purposes.

You must not upload or disclose patient-identifiable information, confidential employer information, personal health information, third-party confidential information or unnecessary special category data in course comments, assignments, messages, discussions or Q&A areas.

If a course activity asks for examples or case reflections, you must anonymise information appropriately and comply with professional confidentiality obligations, employer rules and data protection law.


14. Student contributions, assignments and community features

The Training Site may allow comments, Q&A, discussion posts, assignments, reflections, uploads, messages, reviews or other student contributions.

You remain responsible for any content you submit. You confirm that you have the right to submit it and that it does not breach confidentiality, data protection, intellectual property, professional or legal obligations.

MOBI may review, moderate, edit, remove or restrict access to student contributions where it reasonably considers them unlawful, unsafe, inaccurate, confidential, inappropriate, abusive, discriminatory, infringing, off-topic, misleading or inconsistent with these Terms.

By submitting non-confidential course contributions, you grant MOBI a non-exclusive licence to use them for operating, administering, supporting, moderating and improving the course and Training Site. MOBI will not intentionally publish patient-identifiable information and asks students not to submit it.


15. Intellectual property and permitted use

All course videos, audio, slides, text, graphics, templates, handouts, workbooks, assessments, quizzes, certificates, logos, branding, downloads, recordings and other materials are owned by or licensed to MOBI and are protected by intellectual property laws.

Subject to payment, eligibility and compliance with these Terms, MOBI grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use course materials for your own learning, CPD or internal professional reference only.

You must not copy, reproduce, share, lend, sell, resell, licence, publish, upload, transmit, broadcast, record, scrape, adapt, translate, extract, reverse engineer, create derivative works from, or create competing training materials using MOBI course content without MOBI's prior written consent.

Any permitted downloads are for your personal learning or internal professional use only. They must not be distributed within an organisation unless MOBI has expressly granted an organisational licence.


16. Third-party content, links and resources

The Training Site may include links to third-party websites, embedded content, journal articles, guidance, software, payment pages, video tools or resources. These are provided for convenience or learning support only.

MOBI is not responsible for third-party websites, resources, policies, availability, accuracy, security or content, except where required by law.

Your use of third-party services may be subject to separate terms and privacy notices. You should review them before use.


17. Availability, updates and withdrawal of courses

MOBI aims to keep the Training Site and course materials available, but access may be interrupted by maintenance, technical issues, Teachable downtime, security incidents, internet failures, payment-provider issues, regulatory updates, content updates or circumstances outside MOBI's reasonable control.

MOBI may update, correct, replace, withdraw or restrict course materials where reasonably necessary for accuracy, patient safety, regulatory changes, professional guidance updates, platform requirements, security, legal compliance or business reasons.

Where a paid course is materially withdrawn during a stated access period and no reasonable equivalent, extension or alternative is provided, MOBI will offer an appropriate remedy, such as a refund, credit, transfer or extension, depending on the circumstances and your statutory rights.


18. Data protection, privacy and cookies

MOBI will process personal data in accordance with the Privacy Policy below.

Teachable, payment providers, analytics providers, email providers and other third-party service providers may also process personal data in accordance with their own terms, privacy notices and data processing documentation.

The Training Site may use cookies and similar technologies. Essential cookies may be used to provide login, security, checkout and course access. Non-essential analytics, advertising, tracking or similar technologies should only be used where appropriate information and consent are provided, unless an exemption applies.


19. Warranties and disclaimers

MOBI will provide the Training Site and courses with reasonable care and skill.

Course materials are provided for general educational and professional training purposes and may not be suitable for every student, employer, clinical setting, regulatory context or patient scenario.

MOBI does not warrant that the Training Site will be uninterrupted, error-free, virus-free, compatible with every device, or available at all times.

MOBI does not guarantee any employment, promotion, accreditation, registration, clinical approval, business result, examination result, patient outcome, weight-loss outcome, prescribing authority, regulatory approval or other specific outcome from completing a course.


20. Liability

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, breach of statutory rights, or any liability that cannot legally be limited or excluded.

If you are a consumer, MOBI is responsible for foreseeable loss and damage caused by MOBI's breach of these Terms or failure to use reasonable care and skill. MOBI is not responsible for business losses where you use the Training Site for commercial, business or resale purposes.

If you are a business user, MOBI is not liable for loss of profit, loss of business, loss of revenue, loss of opportunity, loss of goodwill, loss of anticipated savings, loss of data, indirect loss or consequential loss, except where such liability cannot legally be excluded.

For business users, MOBI's total aggregate liability arising from or in connection with a paid course shall not exceed the amount paid by you or your organisation for that course in the 12 months preceding the event giving rise to the claim, except for liabilities that cannot legally be limited.

MOBI is not liable for losses caused by your failure to follow professional standards, local policies, employer requirements, clinical governance, regulatory guidance, patient confidentiality obligations, or your own professional judgment.


21. Suspension and termination of access

MOBI may suspend, restrict or terminate your access to the Training Site or a course where it reasonably believes that you have breached these Terms, failed to pay, provided inaccurate information, misused content, compromised security, infringed rights, or created a risk to MOBI, students, patients, employers, platform integrity or legal compliance.

Where appropriate and lawful, MOBI may give you an opportunity to respond or remedy the issue. Immediate suspension may be used where there is a serious breach, security risk, confidentiality issue, misuse of intellectual property, safeguarding concern or legal requirement.

Termination or expiry of access does not affect accrued rights, payment obligations, intellectual property restrictions, confidentiality obligations, liability provisions, data-retention obligations or any provisions intended to survive termination.


22. Complaints and support

If you have a question, technical issue or complaint about MOBI course content, access decisions, certificates or student support, please contact info@mobi.clinic.

MOBI will aim to acknowledge complaints within 3 working days and respond within a reasonable period depending on the nature and complexity of the issue.

If your complaint relates to Teachable's platform, login, checkout, payment processing or platform functionality, Teachable or the relevant payment provider may need to assist or respond under its own processes.


23. Changes to these Terms

MOBI may update these Terms from time to time. The latest version will be published on the Training Site.

The version published at the time of purchase will normally apply to that purchase, unless an update is required by law, platform requirements, security, patient safety, regulatory requirements or another important reason.

Material changes affecting existing paid access will be notified where reasonably practicable.


24. General legal terms

MOBI may transfer its rights and obligations under these Terms to another organisation where this does not materially reduce your rights. You may not transfer your rights or obligations without MOBI's written consent.

If any part of these Terms is found to be invalid or unenforceable, the remaining parts will continue to apply.

A failure or delay by MOBI in enforcing these Terms does not waive MOBI's right to enforce them later.

These Terms, together with the course page, checkout information and any written course-specific terms, form the agreement between you and MOBI for the relevant course.


25. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales.

If you are a consumer resident in Scotland or Northern Ireland, you may also benefit from mandatory protections and may be able to bring proceedings in your local courts where required by law.

Subject to mandatory consumer rights, the courts of England and Wales have exclusive jurisdiction over disputes arising from or connected with these Terms.


26. Governing law and jurisdiction

Our online training courses are hosted and delivered through the Teachable platform. These Terms govern the relationship between MOBI and students in relation to the purchase, access and use of MOBI’s training courses, course materials, certificates, support and related services. Teachable’s own platform terms, privacy documentation and data processing arrangements govern Teachable’s provision of the technical platform, hosting, account functionality, payment processing support and related platform services.


27. International Users

MOBI is based in the United Kingdom and these Terms are governed by the laws of England and Wales. Our training courses may be accessed by users outside the United Kingdom; however, we do not represent that the courses, course materials, certificates, professional content or website are appropriate, accredited, approved or legally compliant for use in every country or jurisdiction. If you access our courses from outside the UK, you are responsible for ensuring that your access, use and reliance on the course content complies with any laws, professional rules, employer requirements, regulatory standards or CPD requirements applicable in your own location. Nothing in these Terms affects any mandatory consumer rights or data protection rights that may apply to you under the laws of your country of residence and which cannot lawfully be excluded.
